This is a common question that I hear all the time. There is no simple answer. The thing to know first is that if you miss a payment, the bank is not going to foreclose immediately.  Foreclosure is a lengthy process and costs lenders a lot of money so they don’t want to have to foreclose on their borrowers. If you act quickly, you will have time to make an informed decision.

Can I make a partial payment?

No! It’s all or nothing with your monthly payment. Banks will not accept a partial payment and they most likely will send back your check uncashes.

The key is to be proactive in avoiding foreclosure if you think you can’t make your payments. Many people are faced with job losses, illness or family emergencies that cause financial hardship. What are the options?

I ran across a couple the other day that told me that they are not about “the money” but really concerned about  “the people”. Really? Real estate is my business. Loan Mod or Short Sale?

 If you are in a place where you want to buy a home, now may be the right time to start thinking about it. The banks and government are simply overwhelmed with homes that have been repossessed, and it looks like there might be as many as 2 million more homes to come onto the market. Prices in many areas are going to continue to fall, and if you can get credit, mortgage rates are quite low.  You want to meet agents or bankers who are in the “deal flow.” The anecdotal stories of people getting homes for what seem like very good prices, in this depressed market, are all over the internet. There are homes that are certainly below replacement costs in some areas (and not just in the US but in certain parts of Europe as well). While I think home prices should go somewhat lower, we are out of bubble territory. There are starting to be values in the housing market for savvy shoppers. Which of course is what help creates a bottom which I have been writing for many years should happen in 2012-13. So you can be patient, but if you want a home, put in a bid that will make you smile if you get it accepted. No rush. And there are certainly deals for people who can use a little leverage and buy rental property.

 Make a plan

Things change very quickly in the current market! You need a trusted advisor to help you make your game plan. Once we have made your plan we can go forward and invite other players to join our alliance. If you are selling your home, we need to decide what your long term goals are. Are you moving to another city or staying in town? Will you be buying another home or do you need to rent for a while. If you need to sell your house short (AKA short sale) we will need to ally with your current lender to get the transaction completed. If you want to sell your home with or without doing a short sale, we will need to ally with a new buyer. I will make sure that the buyer is qualified before even writing an offer to purchase your home. Lending guidelines are also changing frequently so this is a critical step in the process.

Rule #1: Making an offer that is crazy low will cost you more in the long run!

I just received an offer that was ridiculously low on a listing priced in the 140K range. Sorry folks but asking for 120K PLUS your closing costs is not recommended. The first step to making an offer is to review the comps with your buyer agent. After a close analysis, you will have a good idea of what the house is really worth. Sure, there are deals to be had but typically not among homes that have been fully renovated with all new upgraded interior.  Your agent has the ability to see what the owner paid for the house and then a guestimate (don’t think thats a real word but oh well) can be made as to any recent updates or imrovement costs. Colorado Springs sellers are not desperate unless nearing foreclosure! Even then a low offer may not work.

The end result of the above mentioned situation was a higher counterproposal from the seller than there would have been if the buyer had made a good offer. This does nothing but waste the time of both agents and the seller. If an agreement can be reached regarding price, the tone of the whole transaction is set. Not good! Buyer’s can’t feel that they have a right to steal from any seller, whether in distress or not. I guess that comes from our new culture of “free.” Consumers now expect a coupon, free shipping or other discount when buying something. That may apply to mail order shoes but it does not play well in the Colorado Springs real estate market! Bottom line here is: make a reasonable offer that will actually get what you want–a good house at a fair price. Nothing else will work and you will just end up disappointed!
